ABOUT THE POLICY
This Genetic Use Policy is issued by Blasta Mhor Highland Cattle (Aust) Pty Ltd ABN 82 625 815 492 (Blasta Mhor).
Blasta Mhor makes selected genetics available to breeders for use within their own herds.
Our objective is to allow purchasers to use and enjoy Blasta Mhor genetics in ordinary herd breeding and livestock operations while protecting the long-term integrity, exclusivity and commercial value of those bloodlines.
By purchasing, acquiring or using semen supplied by Blasta Mhor, whether directly or through an authorised distributor, the purchaser acknowledges and agrees to this Genetic Use Policy.
CONDITION OF SALE
All semen supplied by Blasta Mhor is sold subject to this Genetic Use Policy.
The purchaser acknowledges and agrees that:
The semen is supplied for use within the purchaser’s own herd only.
The semen must not be sold, transferred, distributed, gifted, assigned or otherwise supplied to any third party without the prior written consent of Blasta Mhor.
Resulting progeny may be owned, retained, naturally bred from and sold in the ordinary course of livestock ownership, breeding and trading.
Without the prior written consent of Blasta Mhor, the purchaser must not:
collect, market, sell, distribute or otherwise commercially exploit semen derived from resulting animals;
collect, market, sell, distribute or otherwise commercially exploit embryos or ova derived from resulting animals;
undertake or participate in any commercial embryo transfer, embryo production, IVF, ovum pick-up (OPU), cloning or similar reproductive genetics program involving resulting animals;
export or transfer reproductive genetic material derived from resulting animals to any third party or jurisdiction;
permit any third party to collect, market, distribute or commercially exploit reproductive genetic material derived from resulting animals; or
otherwise use resulting animals as part of a commercial reproductive genetics program.
These conditions are intended to protect the integrity and controlled commercial use of Blasta Mhor genetics while permitting ordinary cattle ownership, breeding and livestock trading.
PERMITTED USES
Subject to this policy, purchasers may:
use the semen for artificial insemination within their own herd;
own all resulting calves and cattle outright;
retain resulting progeny;
naturally breed from resulting progeny;
exhibit resulting cattle;
sell resulting cattle in the ordinary course of business;
sell resulting cattle as breeding animals; and
use resulting cattle for normal herd development and commercial cattle operations.
No royalty, licence fee or further payment is payable to Blasta Mhor in respect of ordinary cattle ownership, natural breeding, livestock trading or normal herd operations.
SALE OF RESULTING ANIMALS
Purchasers may sell resulting cattle in the ordinary course of business.
Where resulting animals are sold as breeding stock, purchasers should provide accurate pedigree and breeding information to the purchaser.
The purchase, ownership or sale of a resulting animal does not include any right to collect, market, sell, distribute, export or otherwise commercially exploit reproductive genetic material derived from that animal without the prior written consent of Blasta Mhor.
RECORDS
Purchasers should maintain ordinary breeding records sufficient to identify:
use of Blasta Mhor semen;
resulting calves and cattle; and
approvals granted under this policy.
Blasta Mhor may request access to relevant records only where reasonably required to investigate or verify compliance with this policy.
NO BRAND OR MARKETING RIGHTS
Purchasers may accurately refer to the pedigree and breeding of resulting animals.
Purchasers must not use the Blasta Mhor name, logo, imagery, branding, marketing material or any suggestion of endorsement in connection with any semen program, embryo program, genetic offering, advertising or promotional activity without the prior written consent of Blasta Mhor.
This restriction does not prevent accurate reference to the registered name, pedigree or breeding of an animal.
PURPOSE OF THIS POLICY
This policy is intended to:
protect the integrity of Blasta Mhor bloodlines;
preserve the commercial value of Blasta Mhor genetics;
prevent unauthorised commercial exploitation of reproductive genetics; and
support responsible and sustainable breeding practices.
Nothing in this policy is intended to restrict:
ordinary ownership of cattle;
natural breeding;
normal herd management;
ordinary livestock trading; or
the sale and purchase of live cattle.
Blasta Mhor supports responsible breeders using its genetics to improve their own herds. Written consent is required only where Blasta Mhor genetics are proposed to be used in commercial reproductive genetics programs or for the commercial exploitation of reproductive genetic material.
